Introduction
The purpose of this ColeGeorge Privacy Policy is to inform you, as a
welcome visitor to a CG Website, what kinds of information we may
gather about you and how we may use that information, whether we
disclose it to anyone, and the choices you have regarding our use
of, and your ability to correct, the information.
Definitions
“CG” – ColeGeorge Sports Management
“CG Website” or “Website” – Websites that display this Privacy
Policy and in which CG owns, operates, and/or solely manages and
maintains.
“Affiliate” – A legal entity that CG owns or which are under common
ownership with CG, in which CG has a legal contractual agreement
with, or in which CG utilizes as a subcontractor of Software and
Service.
“Consumer” – A client of CG or a visitor to an CG Website.
“Personal Information” – names, addresses, telephone numbers, email
addresses, credit card information, or other contact information and
personally identifiable data
Overview
CG is strongly committed to protecting the privacy of its Consumers
that utilize its interactive products and services. Since inception,
CG has pledged never to sell or otherwise misuse client information
including (but not limited to) names, addresses, telephone numbers,
email addresses or other personal data of those it collects
(Personal Information). CG only collects this information knowingly
to its Consumer, and will never collect personal data by any means
unless specifically submitted by Consumer. CG considers all Consumer
Personal Information to be private and confidential, and this
information will not be distributed in any manner unless permitted
by Consumer.
CG has a policy against using third party Internet advertising
solution providers and free email services that collect and sell
private data from our users. To protect your information, all
advertising programs for banner ads, databases and software
applications that require Consumer Personal Information reside
exclusively on the CG internal servers and databases. CG will not
release any Personal Information to any party regarding Consumers or
prospective clients.
Many CG Websites link to other websites, and other websites link to
CG Websites. CG is not responsible for the privacy practices of
other companies or the content of websites not owned, operated,
and/or solely managed and maintained by CG. Other organizations may
have their own privacy policies, in which you should review when you
access and/or utilize their services.
Disclosure
We do not use or disclose Personal Information about you or your
individual visits to CG Websites, or information that you may submit
to us through CG Websites, to any outside companies. CG may share
such information in response to legal process, such as a court order
or subpoena, or in special cases such as a physical threat to you or
others. And, as discussed in detail below, we may share collective
statistical information with our Affiliates about the use of CG
Websites.
Information Specifically Relating to CG Website Visitors
Whenever a file is accessed or is attempted access on an CG server,
the relevant CG Website server automatically gathers certain usage
information about that visit (including, without limitation, the
numbers and frequency of its visitors and its specific areas, pages,
and miscellaneous files or applications). The data collected is not
Personal Information, and cannot distinguish an individual user’s
identity. We use this data to help us determine how much our
Consumers use parts of the Website, so we can improve our Website to
assure that it is functioning properly and appealing to our
Consumers. We may provide statistical information of Website usage
to our Affiliates about how Consumers collectively use an CG
Website. We do this so they too can understand how many people,
including various demographics, use specific Website areas
(including areas they may be providing services for) and our Website
as a whole in order for them to help provide you with a positive
Internet experience.
Many CG Websites include various online forms, in which a visitor
may fill out in part or in whole, and submit to CG through the
Website server. Depending on the particular online form, the
information submitted may or may not include Personal Information.
As previously stated, CG considers all Consumer information to be
private and confidential, and this information will not be
distributed in any manner unless permitted by Consumer. In addition,
CG will not distribute any information of a prospective client or
any other contact person that may be submitted through means of an
online form without that person’s written consent.
Some CG Websites may use a technology nicknamed "cookies". These
cookies do not collect Personal Information and we do not combine
information collected through these cookies with other Personal
Information to tell us who you are. CG advertisers may also use
cookies, as well as small pieces of code called "web beacons" or
"clear gifs," to determine on an anonymous basis which
advertisements and promotions users have seen and how users
responded to them, but do not use these technologies to collect
Personal Information unless you give written permission to do so.
CG may specifically ask for information about you when you sign up
to use a service, fill out an online form, or when you order a
product. We may need to obtain certain information, including
Personal Information, so we may provide that service or product to
you. We may also use that information to let you know of additional
products and services about which you might be interested in through
an CG Newsletter. You can choose not to receive such information if
you do not want to by letting us know on the applicable screen when
you sign up for the product or service, or when you fill out an
online form. You will never automatically be included in the CG
Newsletter recipient database unless you specifically opt-in and
request it. Even if you choose to opt-in, you may opt-out of this
information at any time by contacting us.
CG does not control the privacy policies of our advertisers,
sponsors or other sites or businesses to which we provide hyperlinks
or access. Please visit the sites of these businesses to review
their privacy policies. Advertisers or websites that have links on
an CG Website may also collect Personal Information directly from
you. The information practices of other companies collecting data on
an CG Website or companies linked to an CG Website are not covered
by the Athlete Web Services, Inc. Privacy Policy. Be aware that some
online forms may reside on non-CG Websites (if linked off of an CG
Website or of which is noted within that form), in which CG is not
responsible for their privacy practices.
Promotions that run on CG Websites may be sponsored by companies
other than CG or may be co-sponsored by CG and another company. Some
or all Personal Information provided by you during a promotion may
be shared with the sponsor. If information will be shared, we will
disclose such sharing prior to the transfer. You can decide not to
participate in the promotion if you do not want your Personal
Information to be shared. In certain circumstances, you may not be
able to participate in a particular promotion if you chose not to
share certain Personal Information.
Certain CG Websites run competitions or contests through the
Website, and you may be required to provide Personal Information if
you wish to participate. The exact rules may vary in each case but
the specific rules for any contest, if different from this Privacy
Policy, will state how that information may be used.
Consumers should also be aware that, when you voluntarily disclose
Personal Information in bulletin boards, chat rooms, derivations of
fan bio/info lists, etc., that information may be collected by
others and may result in unsolicited messages from others.
It is possible that CG may ask you for information about your
interests so that both you and we can take advantage of the
interactivity of the online medium, but you may always choose
whether or not you want to respond to these questions.
Information Specifically Relating to CG Clients
All CG clients are required to supply certain Personal Information
to CG for its records and to help deliver certain features of
service that contain Personal Information, such as, but not limited
to e-mail and login applications; and to authenticate your access to
your Personal Information. CG considers all client Personal
Information to be private and confidential, and this information
will not be distributed in any manner unless permitted in writing by
client.
Protecting Our Youth
Given the nature of and content included in many CG Websites,
children may be inclined to visit and interact with our Websites. To
help protect the privacy of children, any individual under the age
of thirteen (13) should not send any Personal Information about
themselves without parental consent to CG or through any CG Website.
In general, CG does not knowingly collect and store Personal
Information of children under the age of thirteen without their
parental consent.
There are only a few circumstances for which CG would knowingly
collect a child’s Personal Information that is under the age of
thirteen, WITH PARENTAL CONSENT:
1.) Necessary behind-the-scenes account and/or necessary
service-related information for the following features and services:
Fan clubs, contests, public message boards, public chat rooms,
newsletters, product purchases (online or offline), and special
access or subscription areas (e.g. Kids Zone). UNDER NO CIRCUMSTANCE
WILL CG ALLOW ANY CHILD UNDER THE AGE OF THIRTEEN TO KNOWINGLY HAVE
ACCESS TO ANY PRIVATE CHAT ROOM OR SESSION.
2.) Posting on CG Websites for the following services and features:
Derivations of “fan lists”, contest submissions, contest winners,
article submissions, image or graphic submissions, story or poetry
submissions, fan club member lists, public message boards, public
chat rooms and newsletters. For these features and services, CG or
its Affiliate may post (but no more than) a child’s name, age, city
and state of residence. UNDER NO CIRCUMSTANCE WILL CG KNOWINGLY POST
OR ALLOW POSTING OF ANY CONTACT INFORMATION FOR A CHILD UNDER THE
AGE OF THIRTEEN, OR KNOWINGLY ALLOW SUCH CHILD TO HAVE ACCESS TO ANY
PRIVATE CHAT ROOM OR SESSION.
CG will use any knowingly collected Personal Information of a child
under the age of thirteen for only the means described within the
“Protecting Our Youth” section, and will use this information only
for necessary and official CG and CG Affiliate use for the service
the information was specifically collected for. No Personal
Information of any child under the age of thirteen will be
distributed to any other third party under any circumstance.
CG reserves the right, by law, to send a one-time response to an
email (with appropriate and ethical content) sent by a child under
the age of thirteen if that child sent an email to CG with or
without parental consent. Given that, immediately following the
one-time response if there was no parental consent, CG will delete
the child’s email address and any additional Personal Information
acquired through the email from its contact database. We strive to
help youth enjoy positive online experiences, and enjoy answering
questions or concerns they have regarding any Website-related issue
if and when appropriate.
In the event we learn that we have collected any Personal
Information from a child under the age of thirteen without parental
consent (beside the one exception mentioned above), we will delete
that information from our database immediately. In addition, if at
any time you as a parent would like to request the removal of any
information of your child from an CG Website and/or any relevant
database, please contact us immediately and we will gladly honor
your request.
CG takes special care to protect the safety and privacy of young
individuals using our services, and encourages you to participate in
your child's online experience. We stress the fact that you speak to

Data Security
CG has in place physical, electronic and managerial procedures to
protect the information we collect online. However, as effective as
these measures are, no security system is impenetrable. We cannot
guarantee the security of our database, nor can we guarantee that
the information you supply will not be intercepted while being
transmitted to us over the Internet. Given that, to date and to the
best of our knowledge, no CG database has ever been “hacked” into or
compromised in any way.
ColeGeorge Sports Management Privacy Policy Updates
Technology on the Internet is developing at a rapid pace. If we need
to change our policy in the future, we will post these changes as
soon as they go into effect. We reserve the right to update the
ColeGeorge Sports Management Privacy Policy at any time and without
notice.
